Copyrights are always a big issue so we have put all our "fine print" policy documents here for you to review.  Should you have any questions or concerns, please don't hesitate to get in touch.

All images appearing on the NightinGail Photography website, unless noted otherwise, are the exclusive property of Gail Kenney and are protected un the Canadian and international Copyright laws.  The images may not be reproduced, copied, transmitted or manipulated without the express written permission of Gail Kenney, NightinGail Photography or their designated surrogate.  These copyright laws impose substantial penalties for infringement and violators will be prosecuted to the full extent of the law.

+ right of use

The use of any images or other material included hereon, in whole or in part, for any purpose other than the private viewing of them online, including but not limited to copying, reproduction, publication (including on internet website including third party web pages by any means, including "hotlinking," storae im a retrieval system (other than internet browser), manipulation (digital or otherwise), or trasnmitted in any form or by any means, electronic, mechanical, photocopying, recording, or otherwise, is expressly prohibited without the express written permission IN ADVANCE of Gail Kenney.  All artistic and moral rights of the author are hereby asserted.

+ returns & refunds

Our goal at NightinGail Photography is your complete satisfaction with your purchase and our service.

Due to the nature of digital photography and, that images, once sent, cannot be returned. we have a strict NO REFUNDS POLICY.

Once a transaction has been completed (i.e. the client has selected and paid for the image/photo and NightinGail Photography has sent the buyer the correct image/photo), the transaction is considered complete and non-refundable.

If the purchaser has selected and bought an incorrect image through our on-line store or by e-mail, the client must notify NightinGail Photography, in writing by e-mail to gail@nightingailphotography.com, before receiving the incorrect image.  Refunds WILL NOT be given due to "not liking a photo" or selecting an incorrect image after the client has already received said image; or for any other reason.  

If an incorrect image is sent to the client, as documented on our invoice or through the shopping cart, NightinGail Photography will send the correct photo / digital file to the client at NO CHARGE.

+ refunds & exchanges

ALBUMS ONLY. Due to the custom, pre-designed nature of our Wedding Albums and Coffee Table Books, there are NO REFUNDS on any order.  All albums are considered to be a custom product, and have been approved in writing (e-mail) by the client prior to manufacture.  Therefore, there are NO REFUNDS on these items.

Bridal albums, parent albums, coffee table books and bridal magazines are made to order and cannot be returned or exchanged unless:

  • a manufacturer's defect is evident and reported within 48 hours (2 business days) from the date it was received by the client;
  • damaged during shipping (a separate claim must be filed with the shipping carrier and also must be reported to NightinGail Photography within 48 hours of being received;
  • or in the event that the client's order was erroneously processed such as an error in the size of the book and/or style, when compared to the original approved and recorded order.

It is the purchaser's responsibility to review the custom-design of the order, including spelling and dates, before approving the final design.  No changes will be processed after signed approval has been received by NightinGail Photography.

All prints and products are subject to HST or applicable taxes and shipping costs.  Due to the nature of custom photography, all sales are final.  NightinGail Photography does, of course, guarantee that the portraits you receive meet the highest standards in every respect.  We work with our clients to approve designs and custom work before orders are placed. 

Payments for orders are due in full when the order is placed.  Prints and products will arrive approximately four (4) to six (6) weeks after payment is received.

Albums usually take between four (4) and six (6) months after approval of the design and payment processed as all albums are custom-designed and manufactured by hand.
